Department of Education Threatens Colorado School Funding Over Girls’ Sports

The U.S. Department of Education warned a Colorado school district to stop allowing biological males in girls' sports and facilities within ten days or risk losing federal funding.

According to Breitbart News, the Department of Education announced Wednesday that its Office for Civil Rights sent a warning letter to Jefferson County Public Schools, giving the district a ten-day deadline to comply with Title IX regulations before facing a Letter of Impending Enforcement Action.

Title IX prohibits sex-based discrimination in education programs and activities as a condition for receiving federal funding.

The Office for Civil Rights completed its investigation into the district in March and determined that Jefferson County Public Schools violated Title IX by permitting male students to use female bathrooms, locker rooms, and overnight accommodations, as well as allowing them to compete on girls’ sports teams.

The investigation revealed that the district maintains policies allowing students to access facilities and participate on sports teams based on their self-declared “gender identity” rather than biological sex. Athletic rosters submitted by the district showed that male students may be occupying up to 61 roster positions on girls’ sports teams across the district.

Despite the Office for Civil Rights sending Jefferson County Public Schools a proposed Resolution Agreement to remedy the Title IX violations, the Department of Education stated the district has refused to take action to protect female students. The warning letter makes clear that continued refusal to comply with Title IX could ultimately result in the termination of federal education funding.

Kimberly Richey, Assistant Secretary for Civil Rights, condemned the district’s actions in a statement. Not only did the District trample on females’ sex-based protections by allowing males to compete in their sports, intrude in their bathrooms, and sleep in their overnight accommodations, but now it refuses to fix the problem after being given the chance, Richey stated.

She added that the district’s behavior is indifferent to both the law and the safety, privacy, and dignity of women and girls, calling it unconscionable. Richey warned that the district must restore Title IX protections or face further enforcement action, emphasizing that the Trump Administration will not permit students to be abused by a radical ideological agenda that undermines their legal protections.

The Office for Civil Rights launched its investigation into Jefferson County Public Schools in June 2025 following allegations that the district had eliminated single-sex overnight accommodations from school trips.

The proposed resolution agreement would have required the district to revise its “gender identity” policies to safeguard female students, issue a public statement committing to comply with biology-based definitions of male and female, and mandate that intimate facilities, sports teams, and overnight accommodations be designated based on biological sex, among other corrective measures.

Jefferson County Public Schools did not respond to requests for comment from Breitbart News by publication time.
