Trump Has Chance to Deliver Affordability Win Americans Need

American voters remain deeply frustrated with economic conditions, and targeted patent system reforms could provide the Trump administration with a powerful tool to address affordability concerns ahead of the midterm elections, according to Washington Examiner.
Exit polling from 2025 showed the economy and affordability ranked among voters’ top priorities, and public sentiment has scarcely improved since. Nearly three-quarters of Americans now rate economic conditions as fair or poor, while roughly two-thirds identify the cost of food and consumer goods as a primary economic worry.
The Trump administration has acknowledged the challenge and pledged to pursue policies aimed at making America affordable again. A series of bipartisan adjustments to the nation’s patent framework could prove instrumental in achieving that objective, Washington Examiner reports.
While patent reform may not appear to be an obvious solution to economic anxiety, robust intellectual property protections remain critical for spurring innovation that generates employment, expands economic output, and reduces consumer prices.
Effective patent enforcement enables inventors to capitalize on original creations while giving investors the assurance required to fund experimental technologies and business ventures. Industries that depend heavily on intellectual property account for more than 40% of U.S. economic activity and sustain over 62 million jobs. Workers in patent-intensive sectors also earn higher wages on average compared to those in industries with less IP reliance.
By establishing a framework where companies profit through innovation rather than appropriating competitors’ technology, IP protections cultivate the competitive environment that drives down costs and enhances quality of life.
Yet significant flaws in the current patent system undermine these benefits. Courts seldom issue injunctions to halt patent infringement, leaving startups unable to stop competitors from misappropriating their technology even after proving theft in court. Victims are often limited to pursuing damages after their business has already been damaged.
Supreme Court decisions have also created widespread confusion regarding which inventions qualify for patent protection, even when they satisfy traditional criteria of novelty, non-obviousness, and utility. This uncertainty has suppressed billions in investment, particularly in sectors such as medical diagnostics.
The Patent Trial and Appeal Board presents another complication. Originally conceived as a streamlined alternative to courtroom litigation, the PTAB has instead become an additional forum where powerful corporations challenge smaller rivals’ patents both in court and before the board simultaneously. This dual-track approach forces startups to expend substantial resources defending their intellectual property rights across multiple venues.
The administration and its congressional allies have opportunities to address all three shortcomings. While the White House has taken unilateral action by filing court statements supporting injunctive relief and proposing rules to curb PTAB abuse, legislative solutions would prove far more enduring.
Congress has already begun work on bipartisan measures. The PREVAIL Act would prevent the PTAB from reviewing patents already under court dispute, among other reforms. The Patent Eligibility Restoration Act aims to clarify eligibility standards disrupted by Supreme Court rulings, providing inventors and investors the predictability necessary to bring cutting-edge products to market.
If the president seeks mechanisms to strengthen employment prospects, reduce prices, and stabilize the American economy before voters head to the polls in November, reforming the patent system represents a strategic starting point.
