Rep. Gill Targets Birth Tourism Agencies Across U.S.
A House Oversight Committee investigation led by Rep. Brandon Gill is targeting four birth tourism agencies that help foreign nationals enter the U.S. to give birth for citizenship purposes.
Rep. Brandon Gill (R-TX) is spearheading the probe through his Task Force on Defending Constitutional Rights and Exposing Institutional Abuses, which has issued formal letters to four birth tourism operations across the country, as Breitbart News reports.
The agencies under scrutiny include Have My Baby in Miami, Florida; International Maternity Services based in El Paso, Texas; Doctores Para Ti, also in El Paso; and Dr. Athiya Javid’s OB/GYN clinic located in San Diego, California.
Gill has demanded that each agency produce documentation regarding their childbirth packages, with particular focus on how foreign clients receive guidance about obtaining temporary visas to enter America without disclosing their true intention to give birth on U.S. soil.
In his letter to Have My Baby in Miami executives, Gill emphasized that the birth tourism industry relies on exploiting birthright citizenship as currently interpreted under the 14th Amendment. He noted that while giving birth in the United States is not illegal in itself, deliberately misrepresenting one’s purpose for entering the country on a visitor visa constitutes visa fraud under current law.
In a video post that went viral on social media, Gill outlined the scope of the problem facing the nation.
The Texas congressman called out the Miami-based company by name, explaining that such businesses enable foreigners to enter on visas, deliver their children, and then depart—leaving behind children who retain American citizenship. He declared that the American people have had enough and that his task force is taking action against these operations.
Current estimates indicate that approximately 33,000 children born in the United States each year are granted birthright American citizenship purely because their foreign parents arrived on temporary visas, frequently tourist visas.
The long-term immigration consequences are significant: decades after birth, these U.S.-born children can sponsor their parents for green cards, creating a pathway to permanent residency that circumvents standard immigration procedures.
Birth Tourism Hotspots Across America
The birth tourism industry has established strongholds in multiple regions nationwide. Turkish nationals frequent New York City, Chinese nationals concentrate in California, Russian nationals operate in Florida, and Middle Eastern nationals utilize services in Illinois.
California represents a particularly concentrated hub of activity. Major Federal Prosecutions Reveal Scale of Problem
The Department of Justice has prosecuted several large-scale birth tourism schemes in recent years, exposing the magnitude of the practice.
In December 2020, DOJ prosecutors revealed a massive New York City operation in which more than 100 children born in the United States to foreign visitors were awarded birthright American citizenship through a coordinated birth tourism scheme.
An even larger operation came to light in 2019 when the DOJ uncovered a birth tourism network serving Chinese nationals throughout California. That investigation determined that approximately 8,500 children born in the United States received birthright American citizenship after their foreign parents arrived on tourist visas with the sole purpose of giving birth in America.
The congressional investigation represents the first systematic effort to examine the business operations facilitating what critics describe as exploitation of birthright citizenship provisions originally intended to ensure freed slaves could become citizens after the Civil War.
