Judge exits Georgia election case after courthouse sex scandal
A federal judge with a history of disciplinary issues withdrew from a Georgia election records case after the Justice Department questioned her impartiality due to ties with prosecutor Fani Willis.
US District Judge Eleanor Ross formally recused herself from the case on Tuesday, according to New York Post, after Justice Department attorneys moved to remove her over concerns about potential bias. The judge had previously been sanctioned for multiple serious infractions including inappropriate conduct in her chambers and attending a partisan political gathering.
The recusal came after DOJ lawyers challenged Ross’s ability to fairly preside over a lawsuit against Georgia Secretary of State Brad Raffensperger that seeks an unredacted statewide voter list. The department had raised alarms about Ross attending an event connected to District Attorney Fani Willis, the prosecutor who pursued election interference charges against Trump.
In her recusal order, Ross stated she was stepping aside out of an abundance of caution for the potential perception of bias, noting that both the Trump administration’s current actions and Willis’s previous efforts have become intensely political matters.
Judge Acknowledges Appearance Problem
Ross conceded in her written explanation that an objective observer might reasonably view her attendance at a Willis campaign-sponsored event as indicating support for the district attorney’s position, even though she claimed she only attended to reconnect with former professional colleagues.
The judge has a professional history with Willis, having worked alongside her in the Fulton County District Attorney’s Office before Willis rose to lead that office. Ross acknowledged maintaining a friendship with Willis dating back to 1999 and attending a private mixer held on the margins of the political event.
Prior Disciplinary Actions
Ross received a private reprimand following a judicial investigation that uncovered multiple serious violations of conduct standards. The probe determined that she engaged in sexual activity inside the courthouse with a high-ranking uniformed police officer in her chambers, with courthouse staff within hearing distance.
The investigation also found that Ross attended a partisan political event and subsequently lied when initially confronted about the allegations, only later admitting to the conduct.
Willis Prosecution Ultimately Dismissed
Willis obtained a sweeping indictment in August 2023 charging Trump and 18 co-defendants with participating in an alleged conspiracy to reverse Georgia’s 2020 election outcome. That prosecution, which generated intense political controversy and scrutiny of Willis’s own conduct, was ultimately dismissed in November.
The dismissal came after mounting questions about Willis’s judgment and potential conflicts of interest in pursuing the high-profile case against the now-sitting president.
