Federal Court Greenlights Trump Subpoenas for Trans Clinics
A federal appeals court reversed an injunction blocking Trump administration subpoenas to medical providers giving sex change treatments to minors in a healthcare fraud investigation.
The U.S. Court of Appeals for the Ninth Circuit issued a 2-1 ruling on Friday reversing a district court decision that had halted a subpoena against QueerDoc, a telemedicine clinic that provides sex change treatments. The case has now been remanded to the lower court for further proceedings, according to Breitbart News.
Last year, the Department of Justice announced it had issued more than 20 subpoenas to doctors and medical facilities allegedly providing sex change drugs and surgeries to minors as part of an investigation into healthcare fraud, false statements, and related violations. Until now, these enforcement efforts had been blocked by federal courts.
In their ruling, the appellate panel noted that the long-term risks of administering sex change drugs to minors remain uncertain, and affirmed that a president has the authority to direct the DOJ to enforce laws in accordance with his policy priorities.
Judge Carlos Bea, appointed by President George W. Bush, wrote for the majority that presidential law enforcement priorities are inherently tied to policy objectives. The ruling, joined by Judge Daniel Bress, a Trump appointee, characterized the issue of sex changes for minors as an unsettled scientific debate, stating that the administration can justify its opposition on ethical and philosophical grounds.
The subpoena seeks extensive documentation from QueerDoc, including personnel files, billing records, communications with pharmaceutical manufacturers, and patient records for those prescribed puberty blockers or cross-sex hormones.
Adrien Leavitt, an American Civil Liberties Union attorney representing the Washington state-based clinic, announced plans to continue challenging the subpoena in district court. QueerDoc has argued the demand is overly broad and burdensome, while the Justice Department maintains the company may be misleading the public about sex change drugs.
President Trump has taken decisive executive action on this issue, signing orders that reject gender identity ideology and reaffirm biological reality. He has also moved to end federal funding for sex changes performed on minors, directing the DOJ to prioritize investigations into violations of drug safety laws by entities that may be deceiving the public about the long-term side effects of chemical and surgical mutilation.
The physical consequences of sex change procedures can be devastating and permanent. These include irreversible mutilation, infertility, double mastectomies removing healthy breast tissue, genital mutilation and removal, facial surgeries, hormone treatments, and puberty blockers that can cause chemical sterilization. According to Mayo Clinic, puberty blockers can also have lasting impacts on bone growth, bone density, and normal developmental growth spurts.
A growing number of detransitioners—individuals who underwent these procedures as minors and later reversed course—have come forward to describe the irreversible physical damage and psychological trauma they have endured.
The aggressive promotion of sex-mutilating drugs and surgeries for minors under the euphemistic label of “gender-affirming care” has been driven by academic institutions, large hospital systems, and major medical organizations. The Biden administration actively championed access to these treatments for children.
Transgender activists routinely claim such interventions reduce suicide rates and improve mental health among confused minors—assertions that are increasingly contradicted by emerging studies and data.
Troubling evidence suggests political influence has corrupted gender medicine. The World Professional Association for Transgender Health (WPATH), a leading transgender healthcare organization that advocates for eliminating age limits on sex changes, has been embroiled in multiple scandals. Leaked internal meetings revealed an endocrinologist admitting that discussing long-term infertility risks with a 14-year-old is like talking to a blank wall. The organization has also faced accusations of succumbing to pressure from the Biden administration to remove age requirements for sex change procedures.
WPATH’s guidance influences major hospitals and health organizations across the country, raising serious questions about the politicization of pediatric medical care.
