Texas Democrat Calls for Gun Lock Mandates, Private Sale Bans

Democratic U.S. Senate candidate James Talarico advocates mandatory gun storage laws and banning private firearms sales, calling them "common sense" measures on a recent podcast.

According to Breitbart News, Talarico made the comments during an interview on the Unity Over Division podcast, where he sought to frame his gun control agenda alongside professed support for the Second Amendment.

The Texas Democrat claimed he believes in the Second Amendment as much as the First, then proceeded to argue that permits are required to exercise First Amendment assembly rights before outlining his preferred firearm restrictions.

Talarico stated that safe storage mandates and background checks are necessary to keep everyone safe, though he did not address how such measures would impact lawful gun owners’ ability to defend themselves in emergency situations.

Universal Background Checks Would Criminalize Private Sales

Breitbart News reports that Talarico’s campaign website lists universal background checks among his core priorities under the Public Safety & Justice section. Such requirements would effectively criminalize the private gun sales that American citizens have conducted freely since the Second Amendment was ratified in 1791.

The track record of universal background checks raises serious questions about their effectiveness. California has maintained universal background check requirements since the 1990s, yet the state led the nation in active shooter incidents from 2020 through 2024, demonstrating that determined criminals continue to obtain firearms regardless of such laws.

Additional Restrictions on Popular Rifles

Beyond background check expansion, Talarico’s campaign platform also calls for raising the minimum purchase age for AR-15 rifles and other widely popular semiautomatic firearms. These weapons represent some of the most commonly owned rifles in America, chosen by millions of citizens for home defense, sport shooting, and hunting purposes.

The proposals from Talarico represent a familiar pattern among Democratic candidates who claim to support the Second Amendment while simultaneously advocating for restrictions that would substantially limit how Americans exercise that constitutional right.
