Democrat Senator Claims Pepper-Spray Injury in ICE Protest Clash
Democratic lawmakers including Senator Andy Kim protested outside a New Jersey immigration detention facility Monday, with Kim claiming pepper spray exposure while DHS said demonstrators blocked officers.

Approximately 125 demonstrators assembled outside the Delaney Hall facility, including New Jersey Governor Mikie Sherrill and Senator Andy Kim, both Democrats, along with other state officials, as Breitbart News reports. The protesters claimed to be responding to a hunger strike by detainees and alleged inhumane living conditions inside the facility.
Senator Cory Booker joined the outcry, asserting that detainees at Delaney Hall were striking over human rights concerns. Immigrants at Delaney Hall are on a hunger strike because they are fighting for their human rights, he claimed, calling the conditions deplorable and vowing to conduct oversight at the facility.
The Department of Homeland Security painted a starkly different picture of the event. According to DHS, the demonstrators obstructed law enforcement officers from exiting the ICE facility. When officers issued verbal commands to disperse, protesters refused and continued blocking the entrance.
DHS stated that law enforcement personnel followed proper training protocols and used minimal force necessary to protect themselves, the public, and federal property during the incident.
Senator Kim claimed he experienced difficulty breathing from pepper spray deployed as the crowd grew larger outside the facility. However, DHS explicitly clarified that no individuals were directly struck by pepper ball projectiles, according to Breitbart News.
Kim maintained that ICE agents acted as aggressors and expressed solidarity with the detainees, whom he said were protesting poor food quality and mistreatment. He accused ICE of escalating the situation by deploying an armored vehicle and armed agents rather than addressing facility conditions.
The Democratic senator described witnessing civilians being tackled and restrained while agents fired pepper balls and spray into the crowd. He characterized the incident as lawlessness and called for Delaney Hall to be shut down, terming it an administration failure and a violation of constitutional standards for humane treatment.
DHS responded firmly to such characterizations, stating that the First Amendment protects speech and peaceful assembly but not rioting. The department emphasized it was taking appropriate constitutional measures to uphold the rule of law and protect officers and the public from dangerous rioters. DHS reminded that obstructing law enforcement constitutes a federal crime while assaulting officers is a felony.
Reports indicate that Kim was permitted inside the building and was caught in the pepper spray cloud only after the dispersal action had occurred, Breitbart News reports.
In a Monday press release, DHS accused left-wing politicians of exploiting Memorial Day to spread false information about the detention facility. The department detailed that detainees receive three daily meals along with clean water, clothing, bedding, and personal hygiene supplies.
Illegal immigrants in custody also have telephone access to contact family members and legal counsel, DHS noted. Certified dieticians evaluate all meals provided at the facility. The department emphasized that ICE maintains higher detention standards than most American prisons housing actual United States citizens, and detainees receive comprehensive medical care from their first moment in custody.
Acting Assistant Secretary Lauren Bis dismissed the entire episode as a political stunt orchestrated by New Jersey sanctuary politicians seeking fundraising opportunities. She flatly denied the existence of any hunger strike at Delaney Hall and rejected claims of substandard conditions or abuse at the facility.
Bis questioned why sanctuary politicians were not praising ICE for removing criminals from American streets rather than defending those detained for immigration violations.
