Biden Judge Blocks Idaho Transgender Bathroom Ban
A federal judge in Idaho temporarily blocked a state law restricting bathroom access by biological sex, ruling its provisions are likely unconstitutional and too vaguely written to enforce.
According to Breitbart News, Biden-appointed U.S. District Judge Amanda K. Brailsford issued a 30-page preliminary injunction on Tuesday preventing House Bill 752 from taking effect while legal challenges continue to move forward through the courts. The ruling also granted provisional class-action status to transgender residents statewide, broadening the scope of protections beyond the individuals who originally filed suit.
Judge Brailsford raised concerns about enforcement practicality in her decision, noting that law enforcement officers would face difficulty determining an individual’s biological sex under the framework established by the legislation.
The decision represents a significant setback for Idaho lawmakers and their supporters who championed the bill as a necessary measure to safeguard privacy and security in public restroom facilities. The legislation was framed by its backers as common-sense policy rooted in biological reality and the protection of women and children in intimate spaces.
Constitutional Concerns Over Vague Language
In her ruling, Brailsford identified what she characterized as serious deficiencies in the bill’s language, warning that the lack of precise definitions and clear enforcement guidelines could lead to arbitrary or discriminatory application of the law. The case was brought by multiple transgender Idaho residents represented by the American Civil Liberties Union, ACLU of Idaho, and Lambda Legal.
Paul Carlos Southwick, legal director at the American Civil Liberties Union of Idaho, celebrated the court’s decision, stating it would enable transgender individuals in the state to access public facilities without fear of criminal prosecution. He described the ruling as relief for those who had expressed anxiety about the disruption the law would have caused in their everyday routines.
Kell Olson, an attorney with Lambda Legal, emphasized constitutional requirements for legal clarity, particularly when criminal penalties are at stake. He argued that the Constitution provides essential safeguards against laws that allow officers to make subjective judgments about enforcement, especially when imprisonment is a potential consequence.
The legal battle over Idaho’s bathroom access law continues as advocates on both sides prepare for prolonged litigation over what constitutes permissible state regulation of sex-segregated public spaces.
