The judgment, handed down on Thursday, centers on a case involving a minor identified as R.P., who was born in the United Kingdom and holds Polish citizenship from birth, as The European Conservative<\/em> reports. The applicants in the case were the child himself, his biological mother identified as A.P., and her female partner E.K., both of whom are Polish citizens.<\/p>\n

The family resided in Northampton and maintained strong connections to Poland, speaking Polish at home and traveling to the country regularly.<\/p>\n

Polish authorities refused to register the British birth certificate because it named two women as the child’s parents, a designation that conflicts with Polish law. Poland’s legal framework defines parenthood within the traditional understanding of family, recognizing only a mother and father as parents.<\/p>\n

The Strasbourg-based court found that Poland’s refusal to register the document left the child without proper legal status in Poland, preventing him from obtaining essential identity papers despite his Polish citizenship.<\/p>\n

The ruling represents another instance of the European Court of Human Rights pressuring member states to accommodate legal arrangements that contradict their domestic definitions of family and parenthood.
