The Munich Higher Regional Court on Tuesday confirmed a lower court decision prohibiting ZDF from repeating or distributing four specific claims made in the “ZDF Magazin Royale” program about Arne Sch\u00f6nbohm<\/strong>, who at the time served as president of the Federal Office for Information Security (BSI). The court rejected Sch\u00f6nbohm’s demand for financial compensation of 100,000 euros, according to Nius<\/em>.<\/p>\n

The case has emerged as one of Germany’s most significant media law disputes in recent years, forcing judicial examination of how far satire may go when making accusations about real individuals.<\/p>\n

In October 2022, B\u00f6hmermann’s program devoted one of its investigative segments to Sch\u00f6nbohm, focusing on his previous association with an organization called the “Cyber Security Council Germany,” which had alleged connections to Russian actors. The broadcast created the impression that Sch\u00f6nbohm himself maintained proximity to Russian intelligence services or at minimum represented a security risk.<\/p>\n

Shortly after the program aired, then-Interior Minister Nancy Faeser<\/strong> of the SPD reassigned Sch\u00f6nbohm from his cybersecurity post to the presidency of the Federal Academy for Public Administration, effective January 1, 2023. Disciplinary proceedings were initiated but subsequently dropped in April 2023 for lack of evidence, with no formal disciplinary procedure ever opened.<\/p>\n

The Munich Regional Court initially ruled on December 19, 2024, that the public broadcaster must cease distributing four of the five challenged statements from the program and its website. In a press release obtained by Nius<\/em>, the civil chamber stated that two statements made during the broadcast could be understood by viewers to mean Sch\u00f6nbohm had deliberately maintained contacts with Russian intelligence services.<\/p>\n

The court characterized these as false assertions of fact that violated Sch\u00f6nbohm’s general personal rights. Two additional statements published on the ZDF website were also prohibited.<\/p>\n

During oral arguments preceding the appeals decision, the presiding judge described ZDF’s research as “sloppy at best,” signaling the court’s skepticism toward the broadcaster’s journalistic standards in the matter.<\/p>\n

In January 2026, ZDF Director General Norbert Himmler<\/strong> signed a cease-and-desist declaration committing not to repeat certain characterizations of the court ruling. The move followed Himmler’s appearance on the “Table Today” podcast on November 8, 2025, where he downplayed the lower court decision.<\/p>\n

Himmler had suggested the court did not find that ZDF had “asserted anything false” and claimed “not a single sentence was wrong” in the segment. Sch\u00f6nbohm’s legal team viewed this as a misleading representation of the judicial findings and demanded retraction. Media reports indicate ZDF also covered approximately 1,400 euros in Sch\u00f6nbohm’s legal costs related to that matter.<\/p>\n

Former Official Decries Damage to National Security<\/h2>\n

Despite winning on four of five points, Sch\u00f6nbohm was denied monetary damages in both court instances. Speaking to Nius<\/em> after the initial ruling, he characterized the decision as a clear victory while emphasizing the broader implications.<\/p>\n

Sch\u00f6nbohm stated that the false statements endangered Germany’s security by portraying him as a Russian spy, claims that were picked up by international media from the United States to Japan. He called for significant consequences at ZDF to prevent similar false reporting in the future.<\/p>\n

Both parties had filed appeals against portions of the lower court ruling, but the Munich Higher Regional Court maintained the essential prohibitions while continuing to deny financial compensation.<\/p>\n
