Micha\u0142 Racho\u0144<\/strong>, a senior editor and broadcaster at the conservative independent news channel TV Republika, lost his journalistic privilege protection on June 8 in a case concerning illicitly recorded conversations between Tusk and several associates, according to Brussels Signal<\/em>.<\/p>\n

The court ruling compels Racho\u0144 to disclose his sources for recordings that captured conversations between the Prime Minister and Roman Giertych<\/strong>, a member of parliament from Tusk’s party who also serves as attorney to the Tusk family. The order also covers Giertych’s recorded exchanges with Jaros\u0142aw Kurski<\/strong>, deputy editor-in-chief of the daily Gazeta Wyborcza, portions of which were aired by TV Republika.<\/p>\n

The broadcaster has maintained that none of the material it published involved attorney-client privileged discussions.<\/p>\n

Artur Wdowczyk<\/strong>, Racho\u0144’s attorney, told the portal Niezale\u017cna that the court’s decision was extremely flawed<\/em> and vowed to appeal what he characterized as a non-final ruling.<\/p>\n

Racho\u0144 himself responded defiantly in a video posted on X, declaring his refusal to cooperate with the order. He characterized the Tusk administration as a crypto-dictatorship and stated he would protect his sources regardless of legal consequences, invoking journalistic confidentiality as an absolute principle.<\/p>\n

Echoes of Earlier Tusk Government Crackdown<\/h2>\n

The current case bears striking similarities to an earlier incident during Tusk’s previous tenure as Prime Minister from 2007 to 2014, when the weekly magazine Wprost published a series of illicit recordings involving government officials and business figures.<\/p>\n

Those recordings exposed attempts by a minister to influence Poland’s central bank chief to favor government policies, and captured then-Foreign Minister Rados\u0142aw Sikorski<\/strong> making disparaging remarks about Poland’s relationship with American allies. The recordings also featured vulgar language used by officials in ostensibly private discussions about state matters.<\/p>\n

The embarrassment prompted an aggressive response from authorities at the time. Security services forcibly entered Wprost’s offices and attempted to confiscate the laptop of editor Sylwester Latkowski<\/strong>. Images of Latkowski physically clinging to his laptop as officers tried to wrestle it away went viral, generating criticism even from media outlets typically sympathetic to Tusk.<\/p>\n

No Solidarity This Time<\/h2>\n

The journalistic solidarity that materialized during the Wprost incident has not reemerged in today’s Poland, where two decades of polarization between the liberal left and conservative right have fractured media unity. Pro-liberal outlets supporting Tusk have expressed no sympathy for Racho\u0144 or TV Republika, frequently dismissing them as media workers rather than legitimate journalists.<\/p>\n

TV Republika and another conservative broadcaster, wPolsce24, have been repeatedly barred from government press conferences, while their journalists face regular summons for questioning by public prosecutors over allegations related to their reporting.<\/p>\n

Tomasz Sakiewicz<\/strong>, CEO of TV Republika, was recently interrogated by prosecutors on suspicion of aiding the departure from Poland of former conservative justice minister Zbigniew Ziobro<\/strong>, whom the Tusk government seeks to prosecute for alleged abuse of power.<\/p>\n

Prosecutors questioned Sakiewicz because TV Republika hired Ziobro as a commentator based in the United States, which may have facilitated the former minister’s visa approval. However, Ziobro is not subject to a European Arrest Warrant and had already been granted asylum in Hungary before traveling to America, making any allegation that Sakiewicz or his network facilitated an illegal departure legally baseless.<\/p>\n
