The Immigration and Naturalisation Service has suspended device searches over concerns that the current voluntary handover system violates fundamental rights and operates without sufficient legal authority, according to Brussels Signal<\/em>.<\/p>\n

The decision has triggered sharp warnings from security professionals who say the Netherlands is abandoning a critical layer of border protection at precisely the moment when the EU claims to be tightening asylum procedures.<\/p>\n

Patrick Fluyt<\/strong> of the ACP police union underscored the importance of knowing who is entering the country, particularly given that many asylum applicants arrive from high-risk conflict zones where extremist networks remain active.<\/p>\n

Security Tool Scrapped Over Legal Doubts<\/h2>\n

Dutch border officials have been inspecting arrivals’ smartphones since 2014. Software-based data extraction was introduced following the 2015 Paris terror attacks, according to research from Utrecht University.<\/p>\n

But the Dutch Council of State has ruled that warrantless searches of personal devices constitute a serious infringement on asylum seekers’ rights. On May 28, the Inspectorate for Justice and Security criticized the voluntary system, noting that applicants may feel coerced into handing over devices out of fear that refusal could damage their asylum claims.<\/p>\n

Without a proper statutory foundation, any evidence uncovered through device searches risks being thrown out in criminal proceedings, even if it reveals weapons possession or terrorist connections.<\/p>\n

An internal report from the Immigration and Naturalisation Service warned that abandoning the practice may result in missing relevant security signals<\/em> during initial screening. Both the Central Agency for the Reception of Asylum Seekers and the Repatriation and Departure Service expect to receive less complete information going forward.<\/p>\n

Intelligence Value Lost<\/h2>\n

Ronald Sandee<\/strong>, a former officer with the Dutch Military Intelligence and Security Service and now a security analyst, highlighted the intelligence value of device analysis in verifying asylum claims.<\/p>\n

Device searches can confirm claimed countries of origin, trace travel routes, identify languages used and assess whether asylum narratives hold up under scrutiny. In some cases, the practice has helped detect terrorist intent or links to organizations such as Hamas, particularly relevant amid a recent surge in Palestinian asylum applications in the Netherlands.<\/p>\n

Sandee warned that asylum channels have historically been exploited by hostile states and organizations to insert intelligence operatives and saboteurs, citing potential actors including Russia and China. He called for urgent legislative action to restore the screening capability.<\/p>\n

European Neighbors Maintain Device Checks<\/h2>\n

Germany and Belgium both permit electronic device examination under regulated legal frameworks, offering potential models for the Netherlands to follow.<\/p>\n

Dutch asylum minister Bart van den Brink<\/strong>, who also serves as deputy prime minister, confirmed that work on new legislation is underway. However, no resolution is expected before the EU pact’s implementation deadline.<\/p>\n

The Immigration and Naturalisation Service has stated it will not resume device searches until a proper legal basis exists, despite acknowledging the tool’s value for both security screening and supporting legitimate protection claims.<\/p>\n

Timing Coincides With EU Asylum Overhaul<\/h2>\n

The Dutch Senate approved national legislation implementing the EU Migration and Asylum Pact on May 26, clearing the way for new rules to apply from June 12.<\/p>\n

The pact, negotiated over years amid fierce political divisions, aims to harmonize asylum rules across the bloc through mandatory border screening, expanded use of the Eurodac biometric database and clearer responsibility-sharing among member states.<\/p>\n

Composed of nine regulations and one directive, the pact also establishes faster asylum procedures and stricter return rules for rejected applicants.<\/p>\n

The rollout in the Netherlands, however, now coincides with the elimination of one national security screening layer that had been in place for over a decade.<\/p>\n
