{"id":5164,"date":"2026-06-08T11:00:45","date_gmt":"2026-06-08T08:00:45","guid":{"rendered":"https:\/\/newsfire.gr\/en\/the-fait-accompli-and-adverse-possession-consolidation\/"},"modified":"2026-06-08T11:00:45","modified_gmt":"2026-06-08T08:00:45","slug":"the-fait-accompli-and-adverse-possession-consolidation","status":"publish","type":"post","link":"https:\/\/newsfire.gr\/en\/the-fait-accompli-and-adverse-possession-consolidation\/","title":{"rendered":"The fait accompli and &#8220;adverse possession (consolidation)"},"content":{"rendered":"<p><strong>Fait accompli and &#8220;usucaption (prescription)&#8221;.<\/strong><\/p>\n<p>Our country&#8217;s Foreign Minister, <strong>Mr. Georgios Gerapetritis<\/strong>, stated from the floor of Parliament that <em>any unilateral Turkish action regarding the &#8220;Blue Homeland&#8221; produces no legal consequences under international law and creates no fait accompli in the Aegean<\/em>.<\/p>\n<p>1. Yet the unilateral extension of maritime zones or special statuses of the Blue Homeland east of Turkey&#8217;s 25th Meridian does create both legal consequences and fait accompli.<br \/>\nIt is like a property with title deeds where the neighbor invokes prescriptive rights based on established use, even if the owner shows the legal Title Deeds.<\/p>\n<p>2. Greece has not extended its Territorial Waters from 6 nm to 12 nm that exist within the Eastern Aegean from the 25th Meridian eastward (Article 3 UNCLOS).<br \/>\nTherefore, any attempt by Turkish domestic law regarding the Blue Homeland extending to the Cyclades (25th Meridian) affects the National Sovereignty of our Territorial Waters, which we have not extended as Greece, even though the Foreign Minister himself declared &#8220;indefinitely&#8221; on January 16, 2026 that we will extend them.<\/p>\n<p>3. A potential Turkish domestic law strengthens Turkey&#8217;s casus belli against the National Sovereignty of the 12 nm, which Turkey is attempting to undermine through domestic law.<br \/>\nTurkey is essentially seeking to usurp Greece&#8217;s internationally unlegitimized Territorial Waters from 6 nm to 12 nm.<\/p>\n<p>4. In the event of a potential domestic law, Turkey will attempt to consolidate unilateral claims &#8211; situations such as fishing, the right of Search and Rescue, the Gray Zones, islands not mentioned in the Treaty of Lausanne in 1923 and the Treaty of Paris in 1947, marine parks, firing ranges &amp; Exercises, using tensions &#8211; crises on the ground, while our country remains fixated on the complacency of International Law.<\/p>\n<p>5. The issue of our country&#8217;s sovereign rights concerning the EEZ and the Continental Shelf, regarding which Turkey does not accept International Law&#8217;s position that the islands of the Eastern Aegean have an EEZ and Continental Shelf (Article 121 UNCLOS), will remain unresolved indefinitely.<\/p>\n<p>6.
