Yet before the release warrant could even be prepared, prosecutors hauled him before a second judge via video link on entirely separate charges\u2014this time for allegedly &#8220;praising a crime and a criminal.&#8221;<\/p>\n<p>That second court, the Constantinople 4th criminal judgeship of peace, promptly ordered G\u00f6kta\u015f detained again, citing flight risk and potential tampering with evidence. His lawyers say they were never notified of the second hearing and that a court-appointed attorney appeared in their place. They have pledged to appeal what they describe as a coordinated effort to keep their client behind bars.<\/p>\n<h2>Arrested at Constantinople Airport Over Online Performance<\/h2>\n<p>G\u00f6kta\u015f was originally detained at Constantinople Airport on July 2 upon returning from abroad. The next day, he was jailed following complaints lodged through the Presidential Communication Centre, known as C\u0130MER. Prosecutors in Constantinople said they had received 185 formal complaints about his 90-minute performance, <em>\u00d6l\u00fc Deniz<\/em> (Dead Sea), which was filmed at an open-air venue and uploaded to YouTube on June 24, where it garnered more than 14 million views.<\/p>\n<p>Access to the video was subsequently blocked within Turkey under article 8\/A of Law No. 5651. The initial charges accused G\u00f6kta\u015f of insulting the President and inciting hatred and hostility, following an investigation that began with allegations of publicly denigrating religious values.<\/p>\n<p>Under article 299 of Turkey&#8217;s penal code, insulting the President is a criminal offense punishable by one to four years in prison. G\u00f6kta\u015f has consistently denied any intent to insult religion or the head of state, maintaining that his material is satire.<\/p>\n<h2>New Charges Over Joke About Organized Crime<\/h2>\n<p>The fresh allegation centers on a different segment of the same show. According to his legal team and reporting by Turkish Minute, G\u00f6kta\u015f made a joke about the cost and accessibility of contract killings in Turkey, referencing the Daltonlar, an organized crime group linked to murders and armed attacks.<\/p>\n<p>The court ruled that these remarks constituted praise for the gang, legitimized its crimes, and made criminal services easier to obtain\u2014an offense carrying up to two years in prison. G\u00f6kta\u015f has rejected the interpretation, arguing that the joke was a critique of crime and violence, not an endorsement.<\/p>\n<p>His lawyers have highlighted the timing of the second charge, filed at 5:03 p.m. on August 28, minutes after the release order and outside normal office hours. They contend the maneuver was designed specifically to prevent his release. G\u00f6kta\u015f remains detained at \u00c7orlu Karatepe high-security prison in Tekirda\u011f province, northwest Turkey.<\/p>\n<h2>Comedian Mocks Ordeal from Behind Bars<\/h2>\n<p>On his 58th day in custody, G\u00f6kta\u015f sent a message published on his social media account on August 29, treating the legal carousel with dark humor. He noted that he would be marking the opening of the judicial year, scheduled for September 1, from inside his cell. He quipped that his 90-minute show was generating a new charge roughly every two months.<\/p>\n<p>A former engineering and psychology student, G\u00f6kta\u015f built a substantial online following with stand-up routines that skewered a wide array of public figures, including opposition politicians as well as Erdo\u011fan himself. His arrest\u2014during which he was restrained with reverse handcuffs, a technique typically reserved for violent suspects\u2014sparked protests outside courthouses and drew statements from artists and human rights organizations who argued that satire was being criminalized.<\/p>\n<p>Opposition figures from the Republican People&#8217;s Party (CHP) have visited G\u00f6kta\u015f in detention.
