The legislation mandates that almost all sentences of 12 months or less must be suspended, effectively allowing offenders to remain in the community rather than serve time behind bars.<\/p>\n

Former Justice Secretary David Lammy<\/strong> defended the measures, claiming the country would be made safer by keeping low-level offenders out of prison. However, multiple cases have now emerged of serious offenders who could have faced more than a year in custody walking free.<\/p>\n

Paedophile With 3,000 Child Abuse Images Walks Free<\/h2>\n

In one case highlighted by The Telegraph, Callum Powell<\/strong>, 34, avoided prison despite possessing almost 3,000 indecent images of children. Powell, who had appeared on a parkour YouTube channel with over 11 million subscribers, was found in possession of 178 category A images\u2014the classification reserved for the most serious forms of child abuse.<\/p>\n

District Judge Amanda Kelly<\/strong>, in sentencing Powell, stated the case was so serious that only a custodial sentence could be justified. Powell received an 18-month prison sentence, but his early guilty plea reduced the term to exactly 12 months, allowing him to escape incarceration under the new legislation.<\/p>\n
