When asked about this concern, the former Constitutional Court president stated he would argue almost the opposite.

According to Papier, the radicalisation observed in German politics stems from deficiencies within the parliamentary system itself. The established parties have created what he described as legislative gridlock and representation gaps, which have in turn fueled political extremism. These underlying problems, rather than their symptoms, represent the true threat to democracy, he argued.

Established Parties Accused of Ignoring Voter Concerns

Papier did not mince words in his criticism of Germany’s mainstream political forces. He stated that large segments of the population now believe the established parties no longer address their concerns, interests, wishes and fears, but instead simply ignore them.

The constitutional law expert delivered a harsh assessment of the CDU/CSU, SPD, Greens and FDP, asserting that these parties have lost touch with ordinary citizens in many areas. Many Germans no longer feel represented by their elected officials, Papier emphasised, noting that genuine representation is an essential condition of representative democracy. When this representation exists only on paper rather than in practice, citizens notice, and political support shifts toward the margins.

Half of Germans Doubt Democratic Problem-Solving

The former court president expressed concern about Germany’s current trajectory, revealing that half of all Germans no longer have confidence that the country’s problems can be solved within the framework of the democratic system. He attributed this erosion of trust to years of short-sighted policy decisions and poor political management.

Papier also defended the concept of populism itself, rejecting its use as a blanket pejorative term. He noted that populism can simply mean closeness to the people, though he acknowledged that a particular type of populism becomes problematic when parties pretend complex issues have simple solutions. This negative form of populism, he warned, ultimately produces even greater disappointment and political disillusionment.

Warning Against Weimar Comparisons

The constitutional expert, who previously opposed banning the AfD on grounds that the party does not meet the legal requirements for such action, cautioned against apocalyptic scenarios comparing contemporary Germany to the collapse of the Weimar Republic. He stated unequivocally that Germany does not face a seizure of power by an authoritarian regime, and that such fear-based narratives bear no relation to reality.

Papier argued that comparing today’s situation to the end of the Weimar Republic actually undermines German democracy and the rule of law both domestically and internationally. Those who portray Germany as heading toward a Nazi state are doing damage to the preservation and strengthening of democratic institutions and constitutional governance, he concluded.

The former Constitutional Court president also recently declared the five-percent electoral threshold outdated, according to Junge Freiheit.

With information from Junge Freiheit

Former German Constitutional Court President Hans-Jürgen Papier argues that democracy is threatened not by extremist support but by established parties’ failure to represent voters’ concerns.

[122
6851,8035,7660,25,10482,9700
134
post-12688","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news","tag-constitutional-court","tag-democracy-threat","tag-establishment-parties","tag-germany","tag-hans-jurgen-papier","tag-political-extremism","nfg_topic-europe
["GET
